Jill Sommers was sworn in as a Commissioner of the Commodity Futures Trading Commission on August 8, 2007. Commissioner Sommers serves as Chairman of the Global Markets Advisory Committee, which meets periodically to discuss issues of concern to exchanges, firms, market users and the Commission regarding the regulatory challenges of a global marketplace. Commissioner Sommers has worked in the commodity futures and options industry in a variety of capacities throughout her career. In 2005 she was the Policy Director and Head of Government Affairs for the International Swaps and Derivatives Association, where she worked on a number of over-the-counter derivatives issues. Prior to that, Ms. Sommers worked in the Government Affairs Office of the Chicago Mercantile Exchange, where she was instrumental in overseeing regulatory and legislative affairs for the exchange.

The formation of the Chicago Board of Trade (CBOT), arguably the first modern futures exchange, was born in 1858. Since that date, over 100 independent futures exchanges have developed around the globe. Futures markets are being traded electronically 24x7 on a global basis, however, these markets have developed in a disparate manner with minimal standardisation.

Consequently (and surprisingly) there are virtually no systems that facilitate Straight Through Processing (STP). There is a lack of standardisation of data, golden sources, contract terms for similar contracts, margin algorithms or communications protocols. While there has been significant development of front office applications, the middle and back office has lagged behind. This lack of development in post trade processes is reflected in a selection of inflexible and old middle and back office application systems presented by the vendors.

With new developments such as algorithmic trading and the transition of bilateral OTC contracts to become exchange traded, the pace of market change continues to outstrip the capability of systems. The renewed focus by regulators on the middle and back office is forcing vendors to develop new applications to meet with client requirements.

This session will assess market and vendor developments, the options available to market participants and challenge the notion that true STP can be achieved.

Clearing Credit Default Swaps: Overview & Platform Presentations

The credit crisis has sent infrastructure providers to the drawing board to design a clearing solution for credit derivatives and other over-the-counter products that would mitigate risk and bring transparency to this opaque market. OTC Clearing facilities have existed for several years in the listed derivatives space so it is not surprising that major futures exchanges would extend their product offerings. In addition, new entrants to the market are offering a variety of models to address the problem. This session will start with an introduction to credit default swaps and then give the various platforms the opportunity to provide information on their model and answer questions about their structure. Must these products be standardized? How will these models address the more customized single-name contracts? How are valuation and margin requirements determined? Is there a way to come up with margining that is economically viable for the clearing customer? Is clearing limited to principles only? If customers participate, is customer margin segregated? Will these contracts be converted to a futures product? Is remote clearing permitted?

Each provider will be asked to present:

  • A brief description of the platform including the products being offered, their rationale for the model and the expected timing for launch or activity since launch
  • An overview of ownership and governance structure
  • The regulatory environment in which it will operate
  • Implementation challenges for participants

A panel of industry experts will give an overview of CDS Clearing and pose questions to the infrastructure providers from a business, regulatory, and operational perspective.

Return of the CTA

The performance of CTAs (Commodity Trading Advisors) was one of the few highlights of 2008. In a year notorious for the failure of the majority of alternative investment managers to get into the black, returns of +20% through +50% characterized managed futures funds and prompted a wave of new launches of a scale not seen since the 1987 crash (where again, many CTAs performed strongly). This panel extends from two of the leading global managers in the CTA space each with assets under management of around $15bn, through one of the most successful and flexible middle-sized groups to one of the smallest new entrants investing a bare $1m.
